Southampton Town Police arrested a Rhode Island man earlier this month after he was found camping out at singer Jennifer Lopez’s Water Mill estate.
John M. Dubis, 49, was arrested after workers at the Bay Lane estate discovered him staying in her pool house on August 8 and charged with second-degree burglary and first-degree criminal contempt, both felonies, and fourth-degree stalking and possession of burglar tools, both misdemeanors.
The criminal contempt charge resulted from Mr. Dubis violating an order of protection that Ms. Lopez had obtained against him previously, police said.
According to authorities, Mr. Dubis had been staying in the pool house for about a week. Ms. Lopez was not staying at the home during that time period, police said.
During his arraignment in Southampton Town Justice Court on August 9, Mr. Dubis was remanded to the Suffolk County Jail in Riverside in lieu of $50,000 bail or $100,000 bond. The court also ordered that he undergo a psychiatric evaluation to determine if he was fit to stand trial.
On Wednesday morning, Southampton Town Justice Ed Burke Sr. ruled that Mr. Dubis was unfit to proceed following an examination by two psychiatrists at the Riverside jail.
At the same hearing, which lasted less than five minutes, the Suffolk County district attorney’s office filed a motion asking that Mr. Dubis be evaluated again, this time by a psychiatrist of their choosing. The court will not make a decision on that motion until Thursday, September 5.
Mr. Dubis was returned to jail following the proceedings.
